    2. GENERAL CONDITIONS

    2.1. Purpose

    The purpose of this Agreement is the chartering by the Lessor to the Lessee of the Vessel under the General and Specific Conditions described herein (hereinafter, the “Charter Agreement”).


    2.2. Price and Payment
    Conditions
    50% of the Price shall be paid at the time of Reservation.

    The remaining 50% shall be paid 30 days before the Embarkation Date.
    Payments shall be made by bank transfer to:

    The validity of this Charter Agreement is subject to payment within the agreed deadlines.

    The Price includes only the rental of the Vessel.
    The Price excludes the Skipper, bed linen, bath towels, final cleaning, outboard engine, fuel, lubricants, ice, mooring fees, and other consumables.

    2.3. Deposit
    The Deposit shall cover damages, breakdowns, theft, missing inventory, negligence, or breaches of obligations by the Lessee.
    Any expenses not covered by the Deposit or insurance policy shall be borne by the Lessee.
    Refund of the Deposit may be delayed up to 7 days after disembarkation if inspection of the Vessel cannot be completed.

    2.4. Duration
    The Charter Agreement shall remain in force for the agreed Term.
    The Term may only be extended by written agreement.
    Any delay in disembarkation shall result in financial penalties.
    Bad weather conditions shall not justify delay.
    Delay in embarkation or cancellation during the Term shall not entitle the Lessee to reimbursement.

    2.5. Delivery of the Vessel
    On the Embarkation Date, the Parties shall inspect the Vessel, its equipment, and inventory.

    2.6. Cancellation
    Cancellation up to 30 days before embarkation shall result in loss of 50% of the total Price.
    Cancellation within 30 days before embarkation shall result in loss of 100% of the total Price.
    2.7. Obligations of the Parties
    The Lessor shall deliver the Vessel ready to sail and maintain the relevant insurance policies.
    The Lessee shall use the Vessel responsibly and comply with all applicable regulations.
    The Vessel may only be used for tourist or recreational charter purposes.
    The Lessee shall be responsible for all Crew Members.
    The Lessee shall immediately report any breakdowns, damages, or losses.

    2.8. Breach of Contract
    Any breach of contractual obligations shall be governed by Article 1124 of the Spanish Civil Code.
    Improper use of the Vessel or breach of legislation shall result in automatic termination of the Agreement.

    2.9. Force Majeure
    The Lessor shall not be liable for failure to comply with obligations due to force majeure events.

    2.10. Breakdowns
    If the Vessel cannot be used before embarkation, the Lessor shall attempt to provide a replacement vessel of similar characteristics.
    If no replacement is available, all amounts paid shall be refunded without additional compensation.
    Breakdowns caused by misuse during the charter shall result in total loss of the Deposit and liability for damages.

    2.12. Applicable Law
    This Agreement shall be governed and interpreted in accordance with Spanish law.

    2.13. Jurisdiction
    The Parties submit to the jurisdiction of the Courts and Tribunals of Alicante.

    2.14. Partial Invalidity
    The invalidity of one clause shall not affect the validity of the remaining clauses.

    2.15. Entire Agreement
    This document constitutes the entire agreement between the Parties.


    2.16. Personal Data Protection
    Personal data shall be processed by the Lessor for the purpose of providing the requested service and issuing invoices.
    Data subjects may exercise their rights by contacting luxurycatibiza@gmail.com and attaching a copy of their ID or passport.

    Crew Guidelines

    Luggage

    We recommend:

    • A flexible travel bag, such as a duffel or canvas bag.
    • Avoid bringing hard-shell suitcases as there is no space to store them.
    • In summer, going barefoot on board is the norm. However, the ideal footwear on a catamaran is boat shoes or comfortable sneakers with white or light-colored non-slip soles.
    • Swim shoes are recommended.
    • A waterproof jacket or windbreaker, a sweater, fleece, and a tracksuit or hoodie are useful. (for crossings)
    • Snorkeling masks, tubes, and fins are available on board for you to enjoy the crystal-clear waters. You are also welcome to bring your own equipment.
    • Personal toiletry bag.
    • Sunscreen and sunglasses. Caps or hats.

    House Rules

    No smoking inside the vessel.

    • Do not enter the vessel while wet.
    • Water is limited; rational and moderate use is strongly recommended.
    • Respect is the foundation of understanding between human beings.

    Annex

    The following details the financial compensation that will be withheld from the security deposit as renewal costs due to the loss or deterioration caused by misuse of on-board items. This will be retained without prejudice to any future legal actions that may arise for the restitution of damages and/or loss of earnings.
